Terms of Service

By accessing or using the deadwax mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

deadwax is operated by Nollie Technologies and provides a music discovery and curation platform where users can discover artists, endorse artists, and connect with other users through social features. We may add, modify, suspend, or discontinue features at any time.

3. User Accounts

To use certain features of our Service, you must create an account. You agree to:

  • Provide accurate and complete information when creating your account
  • Maintain the security of your account and credentials
  • Promptly notify us of unauthorized access to your account
  • Accept responsibility for activity under your account

You must be at least 13 years old to create an account and use our Service.

4. User Content

You retain ownership of content you submit or upload to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, use, reproduce, and display that content as needed to operate and provide the Service.

You are solely responsible for your User Content and agree not to submit content that:

  • Infringes intellectual property or other rights of others
  • Contains harmful, abusive, or inappropriate material
  • Impersonates another person or entity

The Service may integrate with third-party providers, including authentication providers (such as Google and Apple), music metadata providers (such as Spotify), and infrastructure providers. Third-party services are governed by their own terms and privacy policies, and your use of those services is at your own risk.

8. Termination and Account Deletion

We may suspend or terminate your account and access to the Service if you violate these Terms or if your conduct is harmful to other users, us, or third parties. You may also delete your account at any time through the app settings. Data handling after account deletion is described in our Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, deadwax SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless deadwax and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

12. Optional Artist Marketing Features

If we introduce artist marketing communications (for example, exclusive merch or ticket announcements), participation will be optional and based on your explicit opt-in. You may withdraw consent at any time through available unsubscribe or settings controls.

13. Changes to Terms

We may update these Terms from time to time. If we do, we will post the updated Terms on this page and revise the "Last updated" date. By continuing to use the Service after updates become effective, you agree to the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict of law principles.
